Request

We are making a FOI request to receive, and see published on the DDC Planning Portal, the Consultee responses from: Environmental Health Manager Senior Natural Environment Officer Tree And Horticulture Officer Heritage Team Environmental Health Manager Senior Natural Environment Officer We would also like to request the provision of discourse with the Applicant, Statkraft, notably further requests for information, surveys, and clarifications. To avoid making further onerous requests in due course, and to save your time, please keep us updated with future discourse with the applicant. Upon advice, given the environmental, historical and community-changing impacts, it is critical to have all information available and fully disclosed. 

Response

The internal consultee responses have now been published on the Council’s website are available on the planning portal.  The correspondence between the Council and applicant’s agent is attached.  Please note that all personal data has been redacted from the attached documents.  Personal data is exempt from disclosure under Regulation 13(1) of the EIRs as the Council considers the names and contact details of individual members of staff and that of third parties to be personal data.  Personal data is defined by Article 4(1) of GDPR and also Section 3 of the Data Protection Act 2018 and the release of this data would contravene the data protection principles. 

It is not possible under the legislation for the Council to continuously send copies of any future correspondence between the local planning authority and the applicant’s agent as and when it is received.  You will need to make a separate request for this information.
